1. Acceptance of Terms

Welcome to BetterGen. By accessing or using our image generation platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting an updated version on our website. Your continued use of the service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

BetterGen provides an image generation platform that allows users to:

• Generate images
• Create and share reusable templates
• Purchase and use credits for image generation
• Earn rewards through template sharing and referrals
• Withdraw earned rewards as monetary compensation

3. User Accounts

3.1 Account Creation

To use our service, you must create an account by providing accurate and complete information. You may register using:

• Email and password
• Google OAuth (we only collect OAuth2 tokens, not your Google password)

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old to use BetterGen. Users under 18 must have parental consent. By using our service, you represent and warrant that you meet these age requirements.

4. Credit System

4.1 Credit Types

BetterGen uses a dual credit system:

• Deposit Balance: Credits purchased or received as bonuses. Used exclusively for image generation. Non-refundable and non-withdrawable.
• Rewards Balance: Credits earned from template usage and referrals. Can be withdrawn as monetary compensation at a rate of 100 credits = $1.00 USD.

4.2 Credit Usage

Credits are consumed based on image generation settings:

• Standard Quality: 10 credits per image
• HD Quality: 20 credits per image

4.3 Welcome Bonus

New users receive 100 free credits upon registration. This bonus is added to the Deposit Balance.

4.4 Refund Policy

Credits are generally non-refundable. If a generation fails due to technical issues on our end, the credits will be refunded to your account automatically.

5. Template System and Rewards

5.1 Template Creation

Users can create templates containing prompts, parameters, and configurations for AI image generation. By creating a template, you grant BetterGen and other users a non-exclusive license to use your template for image generation.

5.2 Reward Distribution

When a template is used for image generation:

• 30% of the generation cost is allocated to the rewards pool
• If the template author shares their own template: 100% of rewards go to the author
• If another user shares the template: 60% to author, 40% to referrer
• Attribution window: 24 hours from click to conversion

5.3 Prohibited Practices

The following practices are strictly prohibited:

• Self-referral or creating multiple accounts to earn rewards
• Fraudulent click generation or bot traffic
• Manipulating the reward system through any means
• Sharing templates with malicious or inappropriate content

Violation of these rules may result in account suspension, reward forfeiture, and termination of service.

6. Withdrawal System

6.1 Withdrawal Requirements

To withdraw rewards:

• Minimum withdrawal: 100 credits ($1.00 USD)
• Valid payment method required (PayPal, bank transfer)
• Account must be in good standing

6.2 Processing Time

Withdrawal requests are reviewed and processed manually by our team. Processing typically takes 5-10 business days. We reserve the right to investigate suspicious activity before processing withdrawals.

6.3 Taxes

You are responsible for any applicable taxes on earned rewards. BetterGen does not provide tax advice. Please consult with a tax professional regarding your obligations.

7. Content and Usage Guidelines

7.1 Acceptable Use

You agree to use BetterGen only for lawful purposes. You may not:

• Generate images depicting illegal activities, violence, or explicit content
• Create deepfakes or misleading content intended to deceive
• Infringe on intellectual property rights of others
• Generate images for harassment, hate speech, or discrimination
• Violate any applicable laws or regulations
• Use the service to compete with or harm BetterGen

7.2 Content Ownership

You retain ownership of images you generate through BetterGen. However, by using our service, you grant BetterGen a worldwide, non-exclusive, royalty-free license to store, display, and process your images as necessary to provide the service.

7.3 Generated Content Disclaimer

Generated images may occasionally produce unexpected or inaccurate results. BetterGen is not responsible for the accuracy, quality, or appropriateness of generated content. Users are responsible for reviewing and verifying all generated images before use.

8. Intellectual Property

8.1 BetterGen Property

All intellectual property rights in the BetterGen platform, including software, design, trademarks, and documentation, are owned by BetterGen or its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.2 Third-Party Technology

BetterGen uses third-party technology for image generation. Your use of the service is also subject to our third-party providers' terms of service and acceptable use policies.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BetterGen SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or technical failures
• Content generated by the AI or actions taken by users
• Unauthorized access to your account or data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO BetterGen IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless BetterGen, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you generate or share through the platform

11. Termination

11.1 Termination by User

You may terminate your account at any time through your account settings. Upon termination:

• Your deposit balance will be forfeited (non-refundable)
• You may request withdrawal of your rewards balance
• Your templates may remain available if previously shared

11.2 Termination by BetterGen

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the platform or other users
• Extended periods of inactivity
• Any other reason at our sole discretion

12. Disclaimer of Warranties

BetterGen IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, reliability, or availability
• Warranties that the service will be uninterrupted or error-free

13. Dispute Resolution

13.1 Governing Law
